General terms and conditions

Application

  • These general rental conditions apply to reservations and agreements regarding  the holiday home “norwegian holiday home” is standing and located at Skreliaveien 974, 4580 Lyngdal, Norway.

  • In these general rental conditions, the term “tenant” is defined as: the person who concludes a rental agreement with the landlord (K. Slagt) regarding the rental of the holiday home.
    The term landlord is defined as: the person (K. Slagt) who concludes a rental agreement with the tenant regarding the rental of the holiday home.

  • These general terms and conditions apply regardless of your (prior) reference to any own terms and conditions or to other general terms and conditions. I reject any terms and conditions referred to or used by you.

  • Agreements deviating from these general terms and conditions are only valid if agreed in writing.

 
Article 1 - Reservations

  1. The landlord only accepts reservations from persons who are 18 years or older. Reservations by persons under that age are also not valid. The landlord reserves the right to refuse a reservation at any time - without giving reasons.

  2. After you have made a reservation, you will receive an agreement, a manual, a welcome letter and directions from the landlord within five days. The conditions described in Article 2 apply to payment of the rental sum.

  3. The landlord requests that you check these documents for accuracy and immediately report any inaccuracies. 

  4. An agreement is concluded between you and the landlord when the reservation is confirmed. The agreement concerns the rental of the holiday home for recreational use, which by its nature is short-term. 

 
Article 2 - Payment

  1. The following conditions apply to payment:

    1. Payments must be made by cashless means;

    2. You must pay 25% of the rental amount within 14 days of the date of reservation. The remaining costs of 75% must be paid 6 weeks before the arrival date.

    3. If your reservation is made within 6 weeks before the arrival date, you must pay 100% of the rental sum in one go upon receipt of the rental agreement.

  2. Payments must be made by transfer to IBAN: NL63RABOo346446449. K. Slagt.
    The rental ends by operation of law after the agreed period has expired. If payment is not made on time, you will be in default immediately after the payment term has expired. In that case, the landlord reserves the right to cancel your reservation and terminate the agreement. Contact the landlord in a timely manner to find a solution.

 
Article 3 - Deposit

  1. The landlord does not charge a deposit.

Article 4 - Changes

  1. If the tenant wishes to make changes to the booking after the booking/agreement has been concluded, the landlord is not obliged to comply. It is at the landlord's discretion whether and to what extent changes will be accepted. In principle, changes cannot be permitted within 4 weeks before arrival.

  2. If, after the booking has been made, the tenant changes the period of stay to a different or non-consecutive/consecutive period of stay, the cancellation provisions as stated in Article 5 apply. In any case, a period of stay is understood to mean a period that is not within the period reserved by the tenant ( and confirmed by the landlord) period of stay.

 
Article 5 - Cancellation
Cancellation by the tenant must always be made in writing. The following conditions apply:​

  • If you cancel up to 42 days before the day of arrival, 25% of the rental price will be charged. owed.

  • If you cancel up to 28 days before the day of arrival, 50% of the rental price will be charged. owed.

  • In case of cancellation from 14 days up to the day of arrival, 100% of the rental price is due.

  • If you have not arrived within 24 hours of the agreed date without further notice, this will be considered a cancellation and 100% of the rental amount will be due

  • In the event of cancellation by the landlord, any monies already paid will be refunded. Unless Article 8 applies.

 
Article 6 – Receipt of key.

  1. The key is handed over by the manager on site or by a code from the key box next to the front door. 

 
Article 7 - Arrival, departure and stay in the holiday home
The following times and behavior apply to arrival, departure and stay, namely:

  1. Arrival after 4:00 PM

  2. Departure before 11am

  3. Arrival after 4 p.m. gives the manager time to get the house in order for the tenant. The holiday home is off the grid, cleaning and stocking takes more time than with "normal" houses. 

  4. The tenant and other users must behave as a good tenant during their stay in and around the house. Also in accordance with local Norwegian regulations. (this could include a ban on open fires during drought)

  5. The holiday home is non-smoking. 

  6. Bringing pets is not allowed.

  7. The rental price does not include final cleaning. €65 per rental period will be charged for this. 

  8. Barbecuing with the available barbecue is permitted (this must be left clean before leaving the house). 

  9. The house should be left as it was found. 


Article  8 - Force majeure

  1. Force majeure on the part of the lessor exists if the execution of the agreement is prevented in whole or in part, temporarily or otherwise, by circumstances beyond the lessor's control. This could include blockages, fire, floods or other exceptional events. 

Article 9 - Liability/complaints/damage  
 

  1. During the relevant rental period, the tenant and other users are fully and severally liable for all damage caused to the house, the inventory and all items belonging to the rented object, unless the tenant and other users can demonstrate that the damage was caused to them. cannot be attributed. The landlord therefore advises you to carefully inspect the inventory for defects upon arrival at the holiday home. If you notice any damage or defects, please report this immediately to the landlord.

  2. The landlord accepts no liability for theft, loss or damage of or to property or persons, of any nature whatsoever, during or as a result of the stay in the holiday home.

  3. The landlord accepts no liability for construction activities on (main) roads, etc. in the area.

  4. The costs of normal maintenance and repair of defects are borne by the lessor. If any defects occur, the tenant must immediately inform the landlord and follow instructions as much as possible.

  5. If you still wish to file a complaint, it must be submitted in writing and with reasons to the landlord within 14 days after leaving the holiday home.   



Article 10 - Departure and final cleaning
If the holiday home is used incorrectly or left behind incorrectly, additional (cleaning) costs may be charged to the tenant. After the end of the stay period, the tenant must:

  • To leave the house (broom) clean and tidy            

  • Everything has been washed clean, dried and placed back in the cupboard;

  • Bed linen to be removed and the duvet covers and linen folded and placed in the bathroom. Hang up wet linen and towels in the bathroom.​

  • Take food back with you and do not leave it in the cupboard(s) and/or refrigerator/freezer;

  • Laying the cushions of the garden furniture in the house.

  • Empty rubbish bins and take waste to the containers in the general car park. 

  • Report any breakages and/or damage to the manager and the landlord.

  • Everything closes well.

  • Article 11 - Applicable law
    All terms and conditions in the rental agreement/house rules, as well as any disputes arising from this, are exclusively governed by Dutch law.
